PISCES OPENING HOURS IN DISPUTE

Complaints have been received from local businesses regarding the Pisces Fish and Chip Shop, which has started opening early in the morning to serve breakfasts. When the planning application was submitted for the development of a fish and chip shop at 15 High Street, the opening hours were limited to between 10.00am and 9.00pm Mondays to Saturdays.

If the owner wishes to operate outside these hours then they will need to apply to the Council to vary the condition of their planning permission that limits the opening hours.  The acceptability of this would be determined against the policies of the Rishton development plan but the impact on other outlets or restuarants arising from new competition is not something that the Council can take into consideration when determining the acceptability of the proposed hours. Hyndburn Borough Council have written to the owner and ask them to submit a planning application to vary the condition.
